AB367 Overview

California Assembly Bill 367 (AB367), enacted in October 2025, is intended to strengthen the resiliency of water infrastructure in fire-prone areas and enhance the effectiveness of firefighting operations. The law requires local water systems to take steps to maintain operations during power outages and other emergencies, and to communicate with emergency responders when changes occur that may impact firefighting efforts that rely on their systems.

 

Key Requirements

  • Development of minimum fire safety standards for fire hardening of critical fire suppression infrastructure and backup energy sources
  • Development of Emergency Preparedness Plans by water providers
  • Identification of critical fire suppression infrastructure or alternative sources of water for fire suppression purposes
  • Annual inspections of critical fire suppression infrastructure
  • 24-hour backup power supply requirement
  • Timely notification of changes to water delivery capacity that could significantly impact firefighting efforts or delay reservoir replenishment
  • Post-fire reporting requirements when more than 10 homes within a service area are destroyed or made uninhabitable

 

Applicability

AB367 applies to community water systems that supply water used in the suppression of fires to more than 20 residences within those areas designated as HIGH or VERY HIGH fire severity zones by the California State Fire Marshal.

It does NOT apply to:

  • Water wholesalers that do not provide retail water service
  • Water delivery systems that are gravity fed and do not require any backup power to continue to operate during a power shutoff event
  • Non-potable, recycled, irrigation, or agricultural systems that are not used for fire suppression

 

Infrastructure ID

For the purposes of AB367, critical infrastructure refers to wells and water pumps that are essential for supplying water for fire suppression in the HIGH and VERY HIGH fire severity zones.

Under AB367, water suppliers must submit an inventory of their baseline critical fire suppression infrastructure or alternative water sources to the Ventura County Sheriff's Emergency Services by May 1, 2026. Suppliers are also required to update this information within 120 days of any changes to their systems.

Reduction in Water Capacity

When changes occur that reduce water delivery capacity in a way that could substantially hinder firefighting operations or significantly delay replenishment of reservoirs, AB367 requires water suppliers to report these changes to Ventura County Sheriff's Emergency Services.

  • During normal operations, notification must occur within 3 business days
  • During a fire event, notification must be made as soon an operator becomes aware of the changes
